Gallo Fitness LLC ("Company," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information obtained through our website at go.gallofitness.com and gallofitness.com, our checkout and enrollment pages, our coaching application, and any related communications (collectively, the "Platform").

By using the Platform or enrolling in a coaching program, you consent to the practices described in this Privacy Policy. If you do not agree, please do not use our Platform or services

2. Information We Collect

2.1 Information You Provide Directly

We collect personal information you provide when you:

Submit a contact, inquiry, or intake form;

Purchase a program or deposit via our checkout pages;

Sign a coaching program agreement or addendum;

Communicate with us via the coaching app, email, or SMS;

Submit weekly check-ins, progress photos, body measurements, or nutrition and training data.

This information may include your name, email address, phone number, mailing address, date of birth, payment card details (last 4 digits only — full card data is processed by our third-party payment processor), health history, body composition data, progress photos, and any other information you voluntarily provide as part of your coaching program.

2.2 Health and Body Composition Data

As a fitness coaching business, we collect sensitive personal information including body weight, body measurements, progress photos, nutrition data, lab work results, and health history disclosures. This information is used solely to provide personalized coaching services and is treated as strictly confidential as described in Section 5 below.

2.3 Automatically Collected Information

When you visit our website or checkout pages, we may automatically collect non-personal information including your IP address, browser type, device type, operating system, pages visited, time spent on pages, and referral URLs. This information is collected through cookies, web beacons, and similar technologies.

2.4 Information Collected Through Marketing Funnels and Lead Forms

If you submit your name, email address, or phone number through any of our landing pages, opt-in forms, or call booking tools; whether or not you enroll in a coaching program, that information is stored in our CRM and marketing platform and used to follow up with you about our programs and services. You may opt out of marketing communications at any time as described in Section 7.

We also use advertising pixels from third-party platforms including Meta (Facebook and Instagram) and Google to measure the performance of our advertisements and to show relevant ads to people who have visited our website. These pixels may collect information about your device and browsing behavior. You can manage your ad preferences through your Meta and Google account settings.

3. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to improve your experience on our Platform, track checkout funnel performance, and measure marketing effectiveness. Third-party tools we use, including, but not limited to, GoHighLevel, Stripe, Meta (Facebook/Instagram), and Google, may also set cookies on your device when you interact with our pages.

You may disable cookies through your browser settings. Disabling cookies may affect the functionality of certain pages. We do not currently respond to "Do Not Track" signals from browsers.

4. How We Use Your Information

We use the personal information we collect to:

Provide, personalize, and improve coaching services;

Process payments and manage billing;

Send onboarding, program access, and coaching-related communications;

Send marketing emails or SMS messages (with your consent, and subject to opt-out rights);

Fulfill legal obligations, including responding to legal process or regulatory requirements;

Protect the rights, safety, and property of the Company and its clients;

Analyze Platform usage and improve our marketing and enrollment processes.

5. Confidentiality of Client Health and Body Composition Data

All progress photos, check-in data, body composition measurements, lab work results, and personal transformation content submitted by you during a coaching program are treated as private and confidential. We will not share, publish, reproduce, or use this information in any public or marketing context without your express prior written consent, as described in the Gallo Fitness Program Agreement.

6. How We Share Your Information

We do not sell your personal information. We may share your information in the following limited circumstances:

6.1 Service Providers
We share information with trusted third-party vendors who help us operate our business, including:

CRM and Marketing Platform (GoHighLevel): Our CRM and marketing automation platform, which processes contact data, form submissions, funnel activity, and program communications on our behalf.

Payment Processing: Payments are processed by our third-party payment processor, which collects and processes payment card information in accordance with its own privacy policy and PCI-DSS compliance standards. We do not store full card numbers on our systems.

Marek Health and other third-party medical providers: If you choose to engage with third-party medical or lab services through a referral from your Coach, those providers collect and process your information independently under their own privacy policies. Gallo Fitness LLC is not responsible for their privacy practices.

Email and SMS communication tools integrated with GHL for program communications and marketing.

Coaching Application: We use a third-party coaching application to deliver your training and nutrition programming, process weekly check-ins, and facilitate coach-client communication. The coaching app you are assigned to will be confirmed during onboarding. That platform processes your coaching data, progress photos, and body composition information in accordance with its own privacy policy.

6.2 Legal Requirements
We may disclose your personal information if required to do so by law, court order, subpoena, or government regulation, or if we believe disclosure is necessary to protect our rights, property, or the safety of our clients.

6.3 Business Transfers
In the event of a merger, acquisition, or sale of all or substantially all of our assets, your personal information may be transferred as part of that transaction. We will notify you of any such change in ownership.

6.4 Referral and Affiliate Programs

We operate a referral program and an affiliate promotion program through which existing clients and participants may share links or codes to invite others to enroll in our coaching programs or purchase access to the Better Man Project community.

If you participate in our referral or affiliate program, we may share limited information, such as confirmation that a referred individual has enrolled or purchased, with the referring party solely for the purpose of tracking and fulfilling referral rewards or affiliate credits. We do not share the referred individual's personal health data, body composition information, or coaching records with the referring party under any circumstances.

If you arrive at our Platform through a referral link or affiliate code, we may record that referral relationship in our CRM platform for tracking purposes. This does not affect how your personal information is collected, used, or protected under this Privacy Policy.

7. Marketing Communications

7.1 Email
By providing your email address at checkout or through our forms, you consent to receive transactional emails related to your program enrollment and coaching services. You may also receive marketing emails about our programs and offers. You may opt out of marketing emails at any time by clicking "unsubscribe" in any email or by contacting us at [email protected]. Transactional emails (such as receipts and onboarding instructions) are not subject to opt-out.

7.2 SMS
SMS messaging is optional. By providing your phone number and consenting to SMS communications, you agree to receive text messages from Gallo Fitness LLC. You may opt out at any time by replying STOP to any message. Message and data rates may apply.

8. Data Security

We implement commercially reasonable technical and organizational measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. Access to your personal information is restricted to authorized personnel and service providers who need it to operate our business.

Despite these measures, no data transmission over the internet or electronic storage method is completely secure. We cannot guarantee absolute security.

9. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce our agreements. Client coaching records, including health and body composition data, are generally retained for a minimum of three (3) years following the conclusion of your program.

10. Your Rights and Choices

You may request to access, correct, update, or delete your personal information at any time by contacting us at [email protected]. We will respond to verifiable requests within a reasonable timeframe. Please note that certain information may be retained as required by law or for legitimate business purposes.

California residents may have additional rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know, the right to delete, and the right to opt out of the sale of personal information (we do not sell personal information). 11. Children's Privacy

Our services are intended for adults aged 21 and older. We do not knowingly collect personal information from children under the age of 18. If we become aware that we have collected information from a child under 18 without parental consent, we will delete it promptly.

12. Third-Party Links

Our Platform may contain links to third-party websites, including third-party payment processors, lab partners, supplement brands, and social media platforms. This Privacy Policy does not apply to those third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.

13. Governing Law

This Privacy Policy is governed by the laws of the Commonwealth of Pennsylvania, consistent with our Program Agreement and Terms of Service.

14. Changes to This Policy

We reserve the right to update this Privacy Policy at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Platform after any changes constitutes your acceptance of the updated policy. For enrolled clients, we will make reasonable efforts to notify you of material changes via email.
